JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The name of petitioner came in this case in confessional statement of co-accused Vikas Kumar, who disclosed that stolen vehicle has been kept in the house of the petitioner. Subsequently, the informant and other police officials raided the house of the petitioner and one motorcycle as well as one maruti car was seized.
The learned counsel for the petitioner submits that the owner of the car has already filed a petition for release of the case before the court below and so far as seized vehicles are concerned, the same have not been recovered from the house of the petitioner and even if the aforesaid recovery assumed to be
Patna High Court Cr.Misc. No.54062 of 2015 (2) dt.01-12-2015 2/2 true, then also, the said recovery was made from open Varandah of the house of the petitioner. Petitioner does not have any criminal antecedent.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Chapra at Saran in connection with Masrakh P.S.Case No. 283 of 2015 (Hemant Kumar Srivastava, J) N.K/- U T
