JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-12-2022 The short facts of the case are that the petitioner had filed an application for grant of arms license, however, the same had stood rejected by an order dated 13.05.2017, passed by the District Magistrate, Saharsa, against which the petitioner preferred an appeal bearing Arms Appeal No. 37 of 2017. The learned Commissioner, Koshi Division, Saharsa, by an order dated 11.12.2018, passed in the said Arms Appeal No.37 of 2017 had remanded the case of the petitioner, for grant of Arms License, back to the District Magistrate, Saharsa for issuing a speaking order after obtaining the requisite report from the Superintendent of Police, Saharsa. Patna High Court CWJC No.2855 of 2022(2) dt.15-12-2022 2/2 petitioner that, till date, no decision has been taken by the District Magistrate, Saharsa, hence, he be directed to pass appropriate orders upon the aforesaid pending application of the petitioner for grant of arms license.

Having regard to the aforesaid facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with a direction to the District Magistrate, Saharsa to dispose off the aforesaid pending application of the petitioner for grant of arms license by passing a reasoned and a speaking order, in accordance with law, within a period of 8 weeks of receipt/production of a copy of this order.
