The petitioner apprehends his arrest in connection with complaint Case No.232 'C' of 2017/Trial No.1799 of 2017 registered under Section 498-A of the Indian Penal Code. The accusation is of torturing the opposite party no.2 by her husband (petitioner) and other other in-laws for nonfulfillment of the dowry demand and also removing the opposite party no.2 from the matrimonial house along with her children. Learned counsel for the petitioner submits that due to petty dispute and misunderstanding, the opposite party no.2 has lodged the present case. While the notice as issued to the
Patna High Court CR. MISC. No.9730 of 2019(5) dt.25-06-2019 2/2 opposite party no.2 under ordinary process has been served upon her but she has chosen not to appear before this Court. Further submission is that despite notice at the time of hearing of the Anticipatory Bail Petition of the petitioner by the court below, the opposite party no.2 did not appear in the court below. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Ara, in connection with Complaint Case No.232 'C' of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
