JUSTICE ALOK KUMAR SINHA ORAL ORDER 31-07-2026 Heard learned counsel for the petitioner, Mr Prasoon Sinha, learned senior counsel, appearing on behalf of the Patna Municipal Corporation, and learned counsel appearing on behalf of the opposite party/State.

2. A show cause has been filed on behalf of opposite party no.2/ Patna Municipal Corporation and in para-7 and 8 of the said show cause, it has been stated as follows:- "7. That on the basis of the aforesaid two

Patna High Court MJC No.349 of 2026(3) dt.31-07-2026 2/3 reports, Vigilance case no.04B/2026 was instituted against the Sunny Kumar under the signature of the Municipal Commissioner, PMC under different sections of the Bihar Municipal Act, 2007, directing the landowner to stop the further construction and to file a Show Cause within five (05) days as to why the unauthorised building in question be not demolished. A copy of the aforesaid order was also forwarded to the Senior SP, Patna as well as the Officer Incharge of the Agamkuan Police Station, Patna to stop the unauthorized construction till further order.

8. That in view of the facts and circumstances as mentioned hereinabove, it is humbly stated that the order passed by the Hon'ble Court dated 17.07.2025 has fully been complied with."

It is submitted by learned senior counsel appearing for the Patna Municipal Corporation that the grievance of the petitioner, which the petitioner had raised through the representation dated 06.12.2024, has been acted upon and the proceeding against Sunny Kumar has been initiated, vide Vigilance Case No. 04B/2026, vide order dated 10.03.2026 contained in Letter No. 4678. He, therefore, submits that since the grievance of the petitioner has been redressed by the

Patna High Court MJC No.349 of 2026(3) dt.31-07-2026 3/3 opposite party/Patna Municipal Corporation, therefore, this contempt application may accordingly be disposed of.

4. Learned counsel appearing for the petitioner is satisfied with the steps taken by the opposite party/Patna Municipal Corporation and accordingly prays that this contempt application be disposed of.

5. Considering the submissions made by the parties, as noted above, the present contempt application stands disposed of in view of the fact that, as per the learned counsel for the petitioner, the complaint/grievance raised by the petitioner, vide representation dated 06.12.2024 has already been acted upon, thereby redressing the grievance(s) raised by the petitioner.
