JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 420,406 and 120B of the Indian Penal Code and section 138 of N.I. Act. The prosecution case is that the complainant gave three lacs rupees as friendly loan to the petitioner on assurance to pay the same within stipulated period but the money was not returned. Subsequently, a cheque of rupees three lacs was issued by the petitioner but the same got bounced.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.1626 of 2016 (2) dt.13-01-2016 2/2 that the petitioner filed Complaint Case No. 27702C of 2014 on 21.6.2014 making accusation under sections 387,384,323,341,342,504 and 506/34 IPC against the complainant for robbing the cheque book and other articles. The petitioner is, by profession, a teacher and there is no proof with regard to payment of money. The complaint filed by the petitioner is earlier in point of time. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Patna in connection with Complaint Case No. 28961 C of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
