JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the victim is languishing in custody since 11.2.2014 in a case registered for the offences punishable under Sections 498A,304B,201 and 120B/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.
The prosecution case is of killing the daughter of the informant within one year of marriage.
It is submitted by the learned counsel for the petitioner that the victim was suffering from some mental ailment and she was being provided medical assistance. It is further submitted that the case does not come within the purview of section 304B IPC since there is no accusation of making demand of dowry.
Patna High Court Cr.Misc. No.56991 of 2015 (3) dt.05-01-2016 2/2 The report of the learned Additional Sessions Judge III, Saran at Chapra dated 21.12.2015 at flag A reflects that three witnesses have been examined and the trial is likely to be concluded within six months.
Considering the aforesaid facts, this court is not inclined to grant bail to the petitioner in connection with S.T. No. 473 of 2014 arising out of Daudpur P.S. Case No. 9 of 2014 pending in the court of learned Addl. Sessions judge III, Saran at Chapra. This application is, accordingly, dismissed.
If the trial is not concluded within six months, the petitioner will be at liberty to renew his prayer for bail. (Dinesh Kumar Singh, J) Anil/- U T
