The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioner submits that there is recovery of 221.760 liters of foreign liquor from the bush near the "Chhath Ghat" situated in the "Arna Chanwar" and there is no recovery from the conscious possession of the petitioner. The petitioner is involved in the same occurrence due to previous enmity which is mentioned in para-3 of the petition. However, petitioner is agreed to deposit Rs.25,000/- (twenty five thousand) in the Juvenile Justice Fund of the State Social Welfare Department.

No.9271 of 2020(2) dt.03-03-2020 2/2 In the aforesaid facts and circumstances of the case, I am inclined to grant anticipatory bail to the above named petitioner, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge (Excise), Gopalganj, in connection with Uchkagaon P.S. Case No. 275 of 2019 (G.R. No. 1418/2019), subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
