2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 316(2), 318(4) of the Bharatiya Nyaya Sanhita.
3. As per prosecution case, this petitioner along with one other F.I.R. named accused person induced the husband of informant into entering a business partnership and took Rs. 27 lacs from him for starting a business. Thereafter, the accused persons started avoiding the husband of informant and failed to provide the business details and when he demanded his money back, they returned only Rs. 10 lacs and misappropriated rest of the amount.

Learned counsel for the petitioner disputes the alleged amount and submits that informant and her late husband had credited a total amount of Rs. 17 lacs in the ICICI A/c No. 259405500565, IFSC Code No. ICIC0002594, Naugachia Branch, Bhagalpur, opened in the name of the partnership firm, spanning from 2nd August 2024 to 4th November 2024 for the purpose of business but due to the untimely demise of the husband of informant, the partnership could not survive and petitioner had already returned the amount of Rs. 10 lacs online, in the account of the husband of informant even before the institution of instant F.I.R. He further submits that petitioner is ready to pay the rest amount i.e., Rs. 7 lacs to the informant in easy installments.

Considering the aforesaid contention made on behalf of the petitioner, this anticipatory bail is provisionally allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on provisional bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Patna in connection with Shastri Nagar P. S. Case No. 667 of 2025,

No.12088 of 2026(4) dt.13-07-2026 3/3 subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita with direction to the petitioner that :- (i) Petitioner shall refund Rs. 3,00,000/- (Rs. Three Lacs) through Bank Draft to the informant at the time of furnishing bail-bond and thereafter, rest amount i.e., Rs. 4,00,000/- (Rs. Four Lacs) shall be refunded in two equal installments of Rs. 2,00,000/- (Rs. Two Lacs) each within six months through Bank Draft to the informant, failing which, the learned court below would be at liberty to cancel the bail-bond. (Prabhat Kumar Singh, J) Navya/- U T
