The specific allegation of firing is against co-accused Munna Yadav and so far as petitioner is concerned, no overt act has been attributed against him.

Learned counsel for the petitioner submits that prior to institution of this case one Matrigarha P.S.Case No. 27 of 1997 has been registered against the petitioner in District Silliguri and the aforesaid case has already been closed and except the aforesaid case there is nothing against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of
