JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 The petitioner seeks regular bail in connection with C2-20 of 2020, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 36 litres of Nepali Saufi liquor from the possession of the petitioner. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case in fact nothing has been recovered in this case. Further he has no criminal antecedent and has been in judicial custody since 07.01.2019 and ready to abide by any condition imposed on him.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on

Patna High Court CR. MISC. No.7802 of 2020(2) dt.18-02-2020 2/2 furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge -cum-Special Judge, Excise, Sitamarhi in connection with C2-20 of 2020 subject to the condition that petitioner will cooperate in investigation and make himself available as and when required by the police, otherwise, the prosecution will be at liberty to move for cancellation of his bail bonds.
