The petitioner has preferred this application for grant of regular bail in a case registered under sections 363 and 34 of the Indian Penal Code to which section 366A of the Indian Penal Code was added subsequently.

As per the prosecution case, the daughter of the informant was kidnapped by the petitioner with bad intention. It is submitted by learned counsel for the petitioner that the allegations as levelled in the F.I.R. are false and concocted. The daughter of the informant who is a major returned and her statement was recorded under section 164 Cr.P.C. (Annexure-2) wherein she has categorically stated that she went out of her own free will and married the petitioner. She

Patna High Court CR. MISC. No.19034 of 2021(2) dt.16-09-2021 2/2 wants to go to her sasural. The petitioner is in custody since 1.10.2020 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the contents of the statement of the daughter of the informant under section 164 Cr.P.C. together with the period in custody and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Tariyani Chowk P.S. Case no. 119 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateII, Sheohar.
