The present application has been filed for quashing of the order dated 22.05.2015 passed by learned Additional Chief Judicial Magistrate, Patna City, Patna, in connection with Complaint Case No.529/2015 whereby the processes has been directed to be issued after cognizance being taken under sections 406, 420, 504, 379 and 323 of the Indian Penal Code.

At the time of taking cognizance, the learned Magistrate has only to see that prima facie case is made out, hence, at this stage, this Court is not inclined to interfere into the matter. The application is disposed of with a liberty to the petitioner to raise all the contentions at the time of framing charge, if charge has still not been framed. (Dinesh Kumar Singh, J) Ashwini/- U T
