JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to fardbeyan of the informant, she came to know about the name of petitioner and other F.I.R accused persons from one Jitendra Yadav, who got the name of petitioner and other accused from the deceased Gautam Yadav on mobile phone prior to the alleged occurrence.

In course of investigation, the aforesaid Jitendra Yadav was examined and he, too, supported the version of informant but submission on behalf of the petitioner is that according to the prosecution case itself, deceased Gautam Yadav along with his cousin brother had gone to his sasural and the mother-in-law of

Patna High Court Cr.Misc. No.38333 of 2015 (4) dt.06-11-2015 2/2 the deceased Gautam Yadav stated that a quarrel took place between the deceased and one Aienwa Devi of her village on the aforesaid date of occurrence and Aienwa Devi supported the aforesaid fact.

Learned counsel for the petitioner submitted that petitioner does not have any concern with Aienwa Devi. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Dharhara P.S.Case No. 207 of 2013 arising out of Jamalpur Rail P.S.Case No. 6 of 2013.
