2. Since both these bail applications arise out of the same P.S. case, they are being taken up together and disposed of by this common order.
3. The petitioners apprehend their arrest in a case
Patna High Court CR. MISC. No.10246 of 2026(5) dt.30-06-2026 2/2 registered for the offence punishable under Sections 103(1) and 3(5) of the B.N.S..
4. As per prosecution case, informant alleged that his father, namely Umesh Mahto, went to the house of petitionerShiv Shankar Mahto to get the survey documents where some altercation took place when the documents were not given. It is further alleged that all the F.I.R. named accused persons, including these petitioner and two unknown persons, armed with spade, rod and badi, assaulted father of informant due to which he sustained multiple injuries and during course of treatment, he succumbed to the injuries. Post mortem report of the deceased supports the prosecution case and doctor has found multiple injuries on the person of the deceased.
5. Considering the facts and circumstances of the case, specific and direct nature of accusation, gravity of offence and materials that have surfaced during investigation, the prayer for grant of anticipatory bail to these petitioners is rejected. (Prabhat Kumar Singh, J) shashank/- U T
