1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Kadamkuan P.S. Case No.820/2023, registered for the offence punishable under Sections 8/20(B), (ii)A/22© of N.D.P.S. Act.
3. Learned counsel for the petitioner submits that this is the second attempt of the petitioner to seek bail. It is next submitted that petitioner had earlier moved this Court seeking regular bail by filing Cr. Misc. No.18138/2024 and the same was permitted to be withdrawn by an order dated 29.03.2024. It is further submitted that as per prosecution case, 495 grams of ganja along with 350 pieces of Pheniramine Maleate Injection I.P. Avil and 415 pieces of Buprenorphine Injection I.P. is alleged to have been recovered from the house of the petitioner. It is further submitted that at the time of occurrence the petitioner was not present in the house rather his brother Chotu
Patna High Court CR. MISC. No.11148 of 2025(5) dt.29-08-2025 2/3 Kumar was arrested. It is next submitted that Chotu Kumar had approached this Court seeking regular bail by filing Cr. Misc. No.87245/2024 and the same was allowed by an order dated 21.02.2025 passed by a learned coordinate Bench. It is next submitted that petitioner is in custody since 20.02.2024 and has antecedent of one case. It is also submitted that charges have been framed as such the petitioner will not abscond rather will cooperate in the trial to prove his innocence.
4. Learned A.P.P. opposes the prayer for bail of the petitioner.

Considering the submission and also taking into consideration the fact that Chotu Kumar has been granted the privilege of regular bail by a learned coordinate Bench, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special N.D.P.S. Act Court No.2, Patna, in connection with Special (NDPS) Case No. 49/2024, arising out of Kadamkuan P.S. Case No.820/2023.
6. However, it is made clear that if the learned trial court comes to a conclusion that petitioner after his release is trying to delay the trial in any manner, the learned trial court
