The petitioner is accused in connection with Sakra P.S. Case No. 172/2015 registered under Sections 363, 364/34 of the Indian Penal Code.

The prosecution case is that on 04.06.2015 at the occasion of marriage ceremony at the house of the informant Jamadar Paswan, his relative Mahindra Paswan and his wife Ramkalia Devi had come to participate. In the night at about 11-12 pm both accused persons with the help of others took three months' son of the informant. When the informant tried to search his three months' son, he could not find his son and on query, Mahindra Paswan and Ramkalia Devi admitted their guilt about the kidnapping of the son of the informant and sending him

Patna High Court Cr.Misc. No.56065 of 2015 (3) dt.17-02-2016 2/2 outside with the help of the petitioner Indrajeet Sahni and Rajesh Paswan. Thereafter, Mahindra Paswan and Ramkalia Devi were handed over to the police and the kidnapped boy was also recovered.

Learned counsel appearing on behalf of the petitioner submits that the name of the petitioner and Rajesh Paswan was disclosed by the co-accused Ramkalia Devi and Mahindra Paswan who had kidnapped the son of the informant.

Further submission is that similarly situated co-accused has already been allowed anticipatory bail by this Court vide order dated 16.10.2015 passed in Cr. Misc. No. 48023/2015. The petitioner having no criminal antecedent is in custody since 01.07.2015.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Manish Kumar Pandey, Judicial Magistrate 1st Class, Muzaffarpur in connection with Sakra P.S.
