The petitioner apprehends his arrest in connection with Special Case (Vigilance) No. 160 of 2018 arising out of Complaint Case No. 106 of 2018) registered for the offences under Sections 147, 384, 406, 420, 467, 468 and 471 of the Indian Penal Code and Section 13(2) read with Section 131(D) and Section 7 of the Prevention of Corruption Act. A counter affidavit has been filed by the opposite party no.2 which is taken on record.

The petitioner has been found involved in the crime as alleged by opposite party no.2 and therefore, the Chairman of

Patna High Court CR. MISC. No.9679 of 2022(4) dt.26-04-2022 2/2 the Bank has given sanction to prosecute him. He has also been found to have violated the guidelines for grant of loan. Considering the above facts, I am not inclined to grant anticipatory bail to the petitioner. This application for anticipatory bail is dismissed.

In case the petitioner surrenders and prays for regular bail before the court below within a period of four weeks from today, the court below will consider the petition for regular bail of the petitioner without being prejudiced by the fact that anticipatory bail petition has been rejected by this Court. He will be free to raise any other grounds available to him for consideration of his regular bail.
