304/2012, G.R.No.

3589/12, S.T.No.114/13 for the offences punishable under Section 304(B) and 34 of the Indian Penal Code pending in the court of learned Additional Sessions Judge- V, Katihar,District- Katihar. It is a third attempt on behalf of the petitioner. Earlier twice this court has rejected the prayer for bail of the petitioner vide order dated 19.12.2013 in Cr. Misc. No. 47744 of 2013 and vide order dated 16.06.2014 in Cr. Misc. No. 21734 of 2014. The petitioner is the husband of the deceased and the wife died of burn injury.

The allegation has been made of pouring K.oil and

In view of nature of allegation against the petitioner, this court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail is rejected. However, the trial court is directed to expedite the trial. If the witnesses did not turn up, the trial court resort all provisions of Cr.P.C. to secure the production of the witnesses.
