JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-01-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Harlakhi P. S. Case No. 61 of 2015 registered under Sections 341, 323, 324, 307, 504, 379, 435, 504/34 of the Indian Penal Code.
It is contended that due to land dispute, a false case has been instituted against the petitioners in retaliation of Harlakhi P. S. Case No. 62 of 2015 dated 05.06.2015 registered under Sections 341, 323, 379, 504 and 506 read with 34 of the
Patna High Court Cr.Misc. No.2140 of 2016 (2) dt.18-01-2016 2/2 Indian Penal Code on the basis of written report submitted by one Sulekha Devi, wife of one Ram Kishore Yadav. Be that as it may, regard being had to the allegation that all persons sustained injuries and one of the injuries was grievous in nature, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, the application for anticipatory bail is rejected.
However, in case, the petitioners surrender and seek bail, the same shall be considered on its own merit without being prejudiced in any manner by this order. (Ashwani Kumar Singh, J.) Kanchan/- U T
