Admittedly, alleged recovery has been made from the house of Prabhajan Kumar Singh and so far as petitioner is concerned, petitioner was not arrested at the spot and it is alleged that he escaped from the house when the raid was conducted. Moreover, one coaccused Shashi Bhushan Singh, who happens to be father of the said Prabhajan Kumar Singh, has already been granted privilege of bail by a bench of this court.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Chandi P.S. Case no. 51/2010. shahid (Hemant Kumar Srivastava,J) U T
