JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 Petitioner Bindeshwari Mandal seek bail in anticipation of his arrest in connection with Kajraili P.S. Case No. 91 of 2018, registered for the offences punishable under Sections 363, 366A and 120B of the Indian Penal Code and Section 8 of the POCSO Act.

There is allegation of kidnapping of minor daughter of the informant against the petitioners.

Submission of the learned counsel for the petitioner is that statement of victim girl recorded under Section 164 Cr.P.C. disclosed that she is aged about 19 years and she has not named this petitioner rather she has stated that she has married with one Sarwan Kumar nephew of the petitioner on her own

In view of the above facts and circumstances, let petitioner Bindeshwari Mandal, above named in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of the learned Additional District & Sessions Judge, 1st Bhagalpur in connection with Kajraili P.S. Case No.91 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
