Petitioner is in custody in connection with Balia P.S. Case No. 360 of 2018 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

In the instant case total 34.920 liters of liquor was seized..

Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner.

The petitioner is in custody since 4.1.2020.

Considering the fact that nothing was recovered from the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be

No.7854 of 2020(2) dt.05-02-2020 2/2 enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Judge,Excise, Act, Begusarai, in connection with Balia P.S. Case No. 360 of 2018 subject to the condition that if the petitioner is found involved in such similar cases in future, the court below shall be at liberty to cancel the bail bonds of the petitioner.
