Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Barhara (Sinha O.P.) P.S. Case No. 468 of 2022 lodged under Sections 147, 323, 341, 307 and 468 of the I.P.C. and later on section 302 of the I.P.C. added.

As per the prosecution case, the F.I.R. has been lodged against ten named accused persons. All ten named accused persons have visited to the house of the informant and assaulted the informant with bricks on his head by which the informant and others were injured, later on the injured died and section 302 of the I.P.C. has been added.

Patna High Court CR. MISC. No.9843 of 2023(2) dt.03-05-2023 2/3 Learned counsel for the petitioner submits that there is one criminal case pending against the petitioner in which he is on bail. He further submits that petitioner is in custody since 28.06.2022. Counsel further submits that similarly situated other co-accused persons have already been granted bail by the Coordinate Bench of this Court vide order dated 19.04.2023 passed in Cr. Misc. No. 421 of 2023.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Barhara (Sinha O.P.) P.S. Case No. 468 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C..

With this observation, the bail application stands allowed.
