Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case for the offence punishable under Section 302/34 of the Indian Penal Code.

F.I.R. has been lodged against unknown. During investigation the name of the petitioner has appeared in the confessional statement of the co-accused, namely, Yogesh Ram, who has stated that the petitioner Ajay Ram has committed the murder of Satyendra Singh due to love affairs with the wife of the victim.

It is submitted that there is no eye witness to the occurrence. Only suspicion has been raised against the petitioner as his name has appeared in the confessional statement of the co-accused Yogesh Yadav, who has already been granted bail. The petitioner has not been

Patna High Court Cr.Misc. No.787 of 2015 (3) dt.09-03-2015 2/2 put on T.I.P. However, the chargesheet has already been submitted and there is no chance of tampering with the witnesses. The petitioner has no criminal antecedents. Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge cum F.T.C.-VIII, Ara in Agiaon Bazar P. S. Case no. 16 of 2014 giving rise to Sessions Trial no. 1 of 2015 after framing of charge with the following conditions :

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J) sudip/- U T
