JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 302, 120 (B)/34 of the Indian Penal Code.

On the alleged date and time of the occurrence, all the FIR named persons including this petitioner brutally assaulted the informant's son by means of lathi and danda, resulting in death of victim on spot.

Specific and direct allegation of overt act is against co-accused persons namely Irfan, Rijwan and Imran. So far as this petitioner is concerned, there is general and omnibus allegation of assault.

No.10338 of 2023(2) dt.27-04-2023 2/2 Similarly situated co-accused has already been allowed prearrest bail by a Co-ordinate Bench of this Court vide Paragraph 13 of the bail petition. Petitioner claims clean antecedent. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. case no 434 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
