====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 19-03-2025 Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks regular bail in connection with Desari P.S. Case No.192 of 2023, registered for the offences punishable under Section 392 of the Indian Penal Code.
3. As per the prosecution case, while informant and her mother were coming on a tempo, on the way two motorcycle borne miscreants came and snatched her golden chain and fled away. It is alleged that on the back of motorcycle there was written the word 'Ahiran'.
4. Learned counsel for the petitioner submits that this is the second bail petition filed on behalf of the petitioner. Earlier the prayer for bail of the petitioner had been dismissed as withdrawn while granting bail to co-accused, namely, Ritesh
Patna High Court CR. MISC. No.9305 of 2025(2) dt.19-03-2025 2/3 Kumar @ Karua vide order dated 18.10.2024 passed in Cr. Misc. No.33690 of 2024. He further submits that the petitioner is innocent and has been falsely implicated in this case. Learned counsel submits that the name of petitioner is transpired in this case during the course of investigation. He further submits that the petitioner was arrested in another case and on the basis of confessional statement, he has been made accused in all the six cases which are his criminal antecedents and except the confessional statement there is no material against him. Learned counsel submits that no incriminating article has been recovered from the possession of petitioner, charge has already been framed against him and he undertakes to cooperate in the investigation. He also submits that petitioner is in custody since 24.02.2024. Learned counsel submits that similarly situated coaccused namely Akhilesh Kumar @ Akhilesh Ray @ Kattaria has been granted bail by this Court vide order dated 18.01.2024 passed in Cr. Misc. No.82471 of 2023
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court CR. MISC. No.9305 of 2025(2) dt.19-03-2025 3/3 bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Desari P.S. Case No.192 of 2023.
