JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 325, 379, 307, 504 and 506 of the Indian Penal Code. The prosecution case is that in the background of land dispute the petitioner no. 1 assaulted the son of the informant namely Raju Kumar Sah causing fracture injury on the wrist whereas petitioner no. 2 assaulted the brother of the informant namely Mahendra Sah.

It is submitted by the learned counsel for the petitioners that accusation has been leveled in the background of the land dispute. There is counter version of the occurrence. The injury report of Raju Kumar Sah contained in Annexure-3 which reflects is simple in nature. The petitioners have also received injury.

No.2836 of 2016 (2) dt.19-01-2016 2/2 Considering the genesis of the occurrence, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Purnea in connection with Amour P.S. Case No. 180 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
