JUSTICE SATYAVRAT VERMA ORAL ORDER 10-03-2022 Heard learned counsel for the petitioners and Mr. Md. Anbzarul Haque Sahara, learned A.P.P. for the State. The petitioners seek bail in connection with Town P.S. Case No. 795 of 2021 instituted for the offences under Sections 30(a), of the Bihar Prohibition & Excise Act. Learned counsel for the petitioners submits that the petitioner is in custody since 31.12.2021, are persons with clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 46.44 liters of liquor from a place outside the house of the petitioners, Learned counsel for the petitioners submits that the recovery was not from the house of the petitioners rather it was

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioners are in custody since 31.12.2021 and charge-sheet has been submitted in the case and persons with clean antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five hundred) with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Judge 1, Begusarai in connection with Town P.S.
