JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2015 The petitioner is languishing in custody since 6-7-2014 in a case registered under sections 363, 366, 34 of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant. The learned counsel for the petitioner has submitted

No.155 of 2015 (2) dt.07-01-2015 2 / 2 that in the statement under section 164 of the Code of Criminal Procedure the victim has got her age recorded as 19 years and the Court has assessed her age as 17 years, and as per the Medical Board's opinion she was found to be 15-16 years. She has stated that she went in the company of the petitioner with whom she was in love.

Considering the submission and the statement of the girl under section 164 of the Code of Criminal Procedure, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each in connection with Barhampur P.S.
