08-12-2015 Heard Sri Sheo Kumar Prasad, learned counsel, who was assisted by Sri Anish Kumar, learned counsel for the petitioner and Sri Akshay Lal Pandit, learned Addl. Public Prosecutor.
The petitioner, who is in custody since 24-04-2015 in Minapur P.S. Case No. 131 of 2015, G.R. No. 1888 of 2015 registered for the offence under Sections 414, 400, 34 of the Indian Penal Code and Section 25(1-B)A, 26, 35 of the Arms Act, 1959, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that besides the present case, the petitioner is accused in one another case also. The accusation is of recovery of one loaded country-made pistol with one cartridge from the possession of the
Patna High Court Cr.Misc. No.52546 of 2015 (2) dt.08-12-2015 2/2 petitioner, besides one motorcycle from the courtyard of house of petitioner alongwith Rs. 8,500/- cash.
In view of period of custody, let the petitioner namely Madan Prasad be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur/concerned court in connection with Minapur P.S. Case No. 131 of 2015 with condition that one of the bailor must be blood relation of the petitioner and secondly, during trial the petitioner shall remain physically present on each and every date. If continuously on two dates, the petitioner fails to appear before the trial court, without prior permission of the trial court, his bail-bond shall stand automatically cancelled.
