The petitioner seeks bail in connection with Rahui P.S. Case No. 329 of 2014 giving rise to Sessions Trial No. 215 of 2015 registered under Sections 366-A of the Indian Penal Code pending in the court of the learned 1st Additional Sessions Judge, Nalanda at Biharsharif.
It has been contended by the learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in the present case. Further contention is that there is no evidence against the petitioner in the whole of the case diary and he is rotting in jail since 12.01.2015.
Patna High Court Cr.Misc. No.52665 of 2015 (3) dt.30-01-2016 On the other hand learned counsel for the State has contended that the petitioner is said to be the person who abducted a minor girl aged about 15-16 years and the victim in her statement recorded under section 164 of the Code of Criminal Procedure, 1973 has categorically stated that she was forcibly abducted and raped by the petitioner.
Regard being had to the gravity of the offence, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. (Ashwani Kumar Singh, J) Amin/- U
