The appellant is apprehending his arrest in connection with Musarigharari P.S.Case No.118 of 2018 , registered for offences punishable under Sections 341, 504/34 of the Indian Penal Code, Section 25(1)(b)(a) of the Arms Act and Section 3(1)(r), 3(1)(s) of SC/ST (Prevention of Atrocities) Act. Allegation as per FIR is that some of the miscreants riding on three motorcycles came and point the point of pistol started abusing and assaulting the informant, however, the villagers assembled and they caught hold to the accused persons, who disclosed name of the appellant. Submission of the learned counsel for the appellant is that he is said to be belongs to SC/ST category, having no criminal antecedent and there is no recovery from his possession.

APP (SJ) No.614 of 2019 dt.05-04-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the appellants, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-I -cum-Special Judge SC & ST Act, Samastipur in connection with Mushrigharari P.S.Case No.118 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this appeal is allowed and the impugned order is set aside.
