JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-02-2016 By way of the present application under section 438 of the Code of Criminal Procedure, the petitioner has renewed his prayer for bail in connection with Chhatauni P.S. Case No.239 of 2014 dated 19.9.2014 registered under sections 341, 323, 324, 307 and 354B read with 34 of the Indian Penal Code. The prayer for bail of the petitioner was earlier dismissed by this Court vide order dated 3.11.2015 passed in Cr. Misc. No.49341 of 2015. It would be evident from the record that on completion of investigation, the police have already submitted charge-sheet against the petitioner on 30th April, 2015. Though another accused person named in the FIR, namely, Satyam Kumar
Patna High Court Cr.Misc. No.7492 of 2016 (2) dt.18-02-2016 2/2 has already faced trial, the petitioner is still absconding. In my opinion, no case for grant of anticipatory bail is made out. Accordingly, the application is dismissed.
