JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Bettiah (Town) P.S. Case No. 501 of 2019 registered for the offence punishable under Sections 346, 366(A), 367, 370, 370A, 372, 373, 376, 120(B) of the Indian Penal code, Section 3, 4, 5, 6, 7, 8 of the Immoral Traffic Act, 1956, Section 4, 6, 12, 17 of the POCSO Act and Section 75, 81 of the Juvenile Justice (Care and Protection of Childrent) Act, 2015.

Allegation as per F.I.R., petitioner was engaged in the Immoral Trafficking and a girl was found from the house of the petitioner.

Submission of the learned counsel for the petitioner is that except one maid servant was found in her house, nothing else has been found against the petitioner. She is in custody

No.7932 of 2020(2) dt.20-02-2020 2/2 since 06.07.2019 whereas the similar other accused persons have similar allegation of serious in nature have been granted bail by the learned co-ordinate Benches of this Cour vide orders dated 27.11.2019 passed in Cr. Misc. No. 69347 of 2019, 19.11.2019 passed in Cr. Misc. No. 69991 of 2019, 13.11.2019 passed in Cr. Misc. No. 65747 of 2019, 04.11.2019 passed in Cr. Misc. No. 65264 of 2019.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 1st Additional District and Sessions Judge-cum-Special Judge, Bettiah, West Champaran in connection with Bettiah (Town) P.S. Case No. 501 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
