Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-03-2022 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioners seek bail in anticipation of their arrest in connection with Sheosagar P.S. Case No. 242 of 2020 instituted for the offence under Sections 147, 148, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation against the petitioners are vague,
Patna High Court CR. MISC. No.19403 of 2021(2) dt.25-03-2022 2/3 general and omnibus and not specific. There is a counter version of the occurrence also vide Sheosagar P.S. Case No. 241 of 2020, which has been lodged against the informant and others. Both sides have received injuries. It has been urged on behalf of the petitioners that because of some instigation, both sides clashed against each other in which both sides have received injuries. So far as the petitioners are concerned, they are not stated to have caused the injury on the informant. The said injury is said to have been caused by one Bhola Dubey, who is not the petitioner before this Court.
Considering the afore-noted background facts, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sasaram, Rohtas, in connection with Sheosagar P.S. Case No. 242 of
Patna High Court CR. MISC. No.19403 of 2021(2) dt.25-03-2022 3/3 2020, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
