JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 The petitioner seeks regular bail in connection with Tajpur P.S. Case No. 202 of 2019, registered for offences punishable under Sections 304(B)/34 of the Indian Penal Code. Petitioner happens to be mother-in-law of the sister of the informant and allegation against her and others is of causing death of the sister of informant.
It has been submitted on behalf of the petitioner that she is mother-in-law and no specific allegation has been attributed to her and she has been in judicial custody since 26.07.2019 and now chargesheet has been submitted and, therefore, there is no chance of tampering with the evidence. Heard learned A.P.P. also.
Having heard both sides, in view of the above submissions, let the petitioner above named, be released on bail
Patna High Court CR. MISC. No.7713 of 2020(2) dt.18-02-2020 2/2 on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Tajpur P.S. Case No. 202 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make herself available as and when required by the court below, failing which, the prosecution shall move for cancellation of her bail bonds.
