Heard the parties.

The petitioner was allowed bail by this Court on 22.01.2020 in Cr. Misc. No. 3204 of 2020 in connection with Narkatiaganj (RPF) Rail P.S. Case No. 04 of 2019 with condition that the petitioner would be released after framing of the charge.

This application is for modification of the condition aforesaid on the ground that an accused who is on bail is not appearing in this case, hence framing of charge is not possible. Moreover, due to COVID-19 effect, normal functioning of the Court is not possible.

Patna High Court CR. MISC. No.8559 of 2020(2) dt.07-07-2020 2/2 Finding substance in the submission aforesaid, order dated 22.01.2020 stands modified to the extent that the petitioner be released immediately on bail, on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Narkatiaganj (R.P.F.) Rail P.S. Case No. 4 of 2019 with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.

Accordingly, this modification application stands disposed of.
