JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 21.9.2014 in a case registered for the offences punishable under Sections 147,148,341,342,323,353,379,504 and 384 of the Indian Penal Code and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that the informant was distributing the scholarship amount to the students, in the meantime, the petitioner who runs a private school, came along with 20-25 unknown persons and started abusing. The petitioner pressurized the informant to give scholarship amount to the students of his school who were not eligible as they had less than 75% attendance. All the accused persons also assaulted and abused the informant. It is submitted by learned counsel for the petitioner that

No.1418 of 2015 (2) dt.14-01-2015 2/2 the accusation has been levelled since the petitioner protested with regard to the irregularities being committed in distribution of the scholarship. It is further submitted that the informant has retracted from the initial version and has filed a petition to that effect before the learned court below.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Raxaul, East Champaran at Motihari in connection with Adapur P.S. Case No. 128 of 2014. (Dinesh Kumar Singh, J) Anil/- U T
