Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. The petitioner seeks bail in connection with a case registered for the offence punishable under Section 30(a) of Bihar Excise Act.

The prosecution case, in short, is that police patrolling party recovered 100 liters Mahua wine from the road side where the petitioner was standing. On seeing the police party, he tried to fled away but he caught by the police.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case and he has no concern with the alleged recovery of the said

Patna High Court CR. MISC. No.9033 of 2022(2) dt.20-07-2022 2/2 wine. The petitioner is in custody since 29.10.2021 and remanded on 30.10.2021 in judicial custody, is a person with clean antecedent and charge-sheet has been submitted in the case.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna City, Patna arising out of Alamganj P.S. Case No. 725 of 2021.
