2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 326, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The prosecution case, in brief, is that on 04.11.2023 at about 4:10 PM, when the informant was sitting alone at his house, all the F.I.R. named accused person including this petitioner armed with country made pistol entered into the house of the informant and open fired on account of which informant sustained firearms injury on left side of his chest.
4. Learned counsel for the petitioner submits that allegation of firing is general and omnibus. Prior to the present F.I.R., the petitioner has filed a case against the informant and others alleging therein that two persons came on a motorcycle
Patna High Court CR. MISC. No.12661 of 2024(3) dt.29-04-2024 2/2 and one of them fired upon his father due to which he sustained injury.
5. However, learned A.P.P. for the State opposed the bail application and submitted that petitioner is named in the F.I.R. and there is specific allegation of firing in which informant sustained bullet injury and petitioner has got five criminal antecedents of similar nature
6. Considering the nature of accusation and criminal antecedents, prayer for anticipatory bail of the petitioner is refused.
