JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. . Petitioner is in jail custody since 04.10.2013 in a case registered under Sections 498A and 379 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.
Admittedly, petitioner is husband of the informant and there is allegation of torture against him but it appears that petitioner has sufficiently be punished by remaining in jail custody since 04.10.2013, moreover, there is nothing on the record as well as in the impugned order of learned Session Judge to show that either in course of investigation, or in course of trial the informant produced any injury report.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,
Patna High Court Cr.Misc. No.610 of 2015 (2) dt.08-01-2015 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P.S.Case No. 86 of 2012.
