The petitioner seeks bail in a case registered for the offence under Sections 25(1-B)a, 26(2), 35 of the Arms Act. It is submitted on behalf of petitioner that no incriminating article has been recovered from the possession of the petitioner and only on suspicion, he has been made accused in this case. In fact, one country-made pistol alongwith one live cartridge has been recovered from the possession of co-accused Santosh Kumar. Petitioner is in custody since 31.01.2021. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the

Patna High Court CR. MISC. No.9775 of 2022(2) dt.21-04-2022 2/2 bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S. Case No. 65 of 2021.
