2. The petitioner is in custody in connection with Charpokhari P.S. Case No. 209 of 2023 registered for an offence punishable under Section 414 of the IPC and Section 25(1-b)a 26 and 35 of the Arms Act.
3. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that the petitioner was neither arrested on spot nor anything was recovered from his possession. Petitioner is in custody since 28.10.2023.
4. Learned APP for the State opposes the prayer for regular bail of the petitioner.

From perusal of the first information report, seizure list and impugned order dated 17.01.2024, it appears that one country made pistol recovered from the possession of the petitioner but no independent witness of seizure list and petitioner is in custody since 28.10.2023, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara in connection with Charpokhari P.S.
