====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 19-01-2022 Heard learned counsel for the petitioner and learned APP for the State.

Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.

The prosecution case as per F.I.R is that tractor and trailer of the informant was missing. He has alleged

No.19193 of 2021(3) dt.19-01-2022 2/3 in the F.I.R that his driver Baleshwar Rai and Awdesh Rai brought the tractor and trailer to their village on 09.06.2020 and in next the morning, Awdesh Rai informed the informant that the said tractor was stolen and when the informant enquired the matter and went to the house of his driver, he came to know that his tractor was not brought in the night at the house of his driver. During investigation, the police arrested one Rohit Kumar who stated in his confessional statement that he along with his associates planned to steal and sale the said tractor and trailer. It is alleged against this petitioner that he along with other accused persons handed over the tractor to one Santosh Kumar to sale it. It is submitted by learned counsel for the petitioner that petitioner was not named in the F.I.R and his name sprang up on the confessional statement of Rohit Kumar. Nothing has been recovered from the conscious and constructive possession of the petitioner. A statement has been made in para 3 of the petition that

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 243 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
