The petitioner is apprehending his arrest in connection with Ghanshyampur PS Case No. 150 of 2023, FIR dated 19.06.2023, registered for the offences punishable under Sections 341, 323, 354(A), 307, 504 and 506 read with Section 34 of the Indian Penal Code and later Section 302 of the IPC was added.

According to prosecution case, the petitioner along with co-accused person armed with danda and lathi assaulted the husband of the informant due to which he sustained head
Patna High Court CR. MISC. No.16415 of 2024(3) dt.18-04-2024 2/3 and hand injury. It is further alleged that one Mukesh Singh along with another co-accused person also abused the family members of the informant.

Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case and the allegation levelled in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR.

The learned Additional Public Prosecutor for the State on the other hand on the basis of materials available on record and case diary has vehemently opposed the prayer for bail of the petitioner and submits that from perusal of the FIR it appears that there is direct and specific allegation against the petitioner that he has assaulted the husband of the informant on his head and post-mortem report also supports the allegation levelled in the FIR and apart from that the cause of death as suggested by the post-mortem report is head injury. 6.
Considering the aforesaid facts and circumstances and the fact that there is direct allegation against the petitioner supported by medical evidence, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Ghanshyampur PS Case No. 150 of 2023, pending in the Court
Patna High Court CR. MISC. No.16415 of 2024(3) dt.18-04-2024 3/3 of Judicial Magistrate 1st Class, Benipur, Darbhanga Camp Court.
