The petitioner seeks bail in a case instituted for the offences under Sections 366 and 366A of the Indian Penal Code.

Earlier this Court vide order dated 19.3.2014 passed in Cr. Misc. No.45473 of 2013 rejected the prayer for bail of the petitioner with a direction to conclude the trial within nine months and if the trial is not concluded within the aforesaid time, the petitioner will at liberty to renew his prayer for bail. The petitioner is in jail since 17.10.2012.

Looking to the period of custody, let the petitioner, Madhukant Patel @ Guddu @ Suttu, be released on bail on

Patna High Court Cr.Misc. No.487 of 2015 (2) dt.14-01-2015 furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.D.J. III, Vaishali at Hajipur in Sessions Trial no.90 of 2014, arising out of Patepur P.S. Case No. 141 of 2012, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioner (ii) If the petitioner is found involved in future in similar type of case the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order including cancellation of bail and (iii) petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner.
