JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 22-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Sursand P. S. Case No. 266 of 2015 registered under Sections 341, 323, 504, 379, 380 and 427/34 of the Indian Penal Code. It is contended that the petitioner has got no criminal antecedent and he has been implicated in the present case by the informant in order to save himself from the counter case, i.e., Sursand P. S. Case No. 265 of 2015 instituted on the basis of the written report submitted by co-accused Purusottam Kumar. It is further contended that the non-bailable offences in the present case are under Sections 379 and 380 of the Indian Penal

Patna High Court Cr.Misc. No.2321 of 2016 (2) dt.22-01-2016 2/2 Code and the allegation in this regard is ornamental in nature. Be that as it may, regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi in Sursand P. S. Case No. 266 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
