The petitioner seeks regular bail in Samastipur ST/SC P.S. Case No. 12 of 2000 for the offence Sections 147, 148, 149, 323, 341, 342, 354, 452, 380 of the Indian Penal code and Section 3(X) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Learned counsel for the petitioner submits that the petitioner was granted bail under Section 167(2) of the Code of Criminal Procedure, but the petitioner did not appear. The petitioner was produced on 25.02.2005. Thereafter, he did not appear in the court. The bail bond of the petitioner was cancelled in the year 2006.

It appears that the petitioner misused the privilege of bail for about 8 years and, for that, he has remained in jail for two

Considering the facts aforesaid, the petitioner named above is directed to be released on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Biroul at Benipur, Darbhanga in Samastipur SC/ST P.S. Case No. 12 of 2000.
