JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-05-2019 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Ladaniya P.S. Case No.101 of 2018, registered under Sections 498(A), 304(B) and 506/34 of the Indian Penal Code, pending in the court of A.C.J.M.-IV, Madhubani. The accusation is of killing the daughter of the informant by her husband and in-laws due to non-fulfillment of demand of dowry.

Learned counsel for the petitioner submits that admittedly, petitioner is the husband of the deceased and she died within seven years of marriage. Further submission is that due to quarrel in the family, deceased fell down on the ground

Learned counsel for the State submits that the dead body of the daughter of the informant was found at the house of the petitioners and in the postmortem report, one multiple bruise was found.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
