JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-12-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner no. 1 is father-in-law whereas petitioner no. 2 is younger brother-in-law of the so called deceased of the present case.
Initially, the case was registered under section 304 B, 201,120B of the Indian Penal Code but after due investigation, police found the case true under section 302,201,120B of the Indian Penal Code though the dead body of the deceased has not been recovered as yet. Moreover, except suspicion, there appears to be nothing against the petitioners.
Accordingly, let the petitioners, above named, be
Patna High Court Cr.Misc. No.54140 of 2015 (2) dt.02-12-2015 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkauliya P.S.case No. 573 of 2015.
